Verdicts & Victories (X): Nieto Jones obtains compensation for their client for improper inclusion in debtor's list

Following the lawsuit filed by Nieto Jones, the First Instance Court of Gandesa (Tarragona) has ordered the telecommunications company Orange to compensate their client for having improperly included them in a debtor's list. The sentence quantified the compensation at €1,500 plus interest.

The client's inclusion in a credit reporting agency's database

On June 27, 2023, the client received a letter from Experian-Badexcug, informing them that they have been included in a debtor's list by Jazztel  (part of the Orange group ) for an alleged debt of €1,008.67. However, this debt did not exist, making this inclusion in the database clearly unlawful.

Faced with this situation, we were forced to contact the company responsible for the debtors list database to have their client's inclusion removed. Finally, three weeks later, the details were removed from the database.

The lawsuit filed by Nieto Jones

Since the damage to the client's name had already occurred, Nieto Jones took charge of the matter and, on February 16, 2024, filed a lawsuit to protect the fundamental rights to honor and the protection of personal data, demanding that the damage suffered by the client be duly compensated.

The sentence

On September 29, 2025, the First Instance Court of Gandesa issued a judgment in favor of the plaintiff, declaring that the defendant had violated the plaintiff's fundamental rights to honor and personal data protection by including them in the "BADEXCUG (EXPERIAN)" debtor's file. The defendant was ordered to compensate the plaintiff for the harm caused and Orange was ordered to pay €1,500, plus legal interests.
