Verdicts & Victories (IX): Nieto Jones manages to recover client's mortgage expenses

At Nieto Jones, we have successfully obtained a ruling from the First Instance Court and Preliminary Investigation No. 1 of Loja (Granada) ordering Caja Rural de Granada to reimburse our client for mortgage expenses unduly paid, plus interest.

The mortgage loan and related expenses

During the years 2006, 2007, and 2018, the consumer took out a mortgage loan and two loan modifications with Caja Rural de Granada. As was common practice at that time, the financial institution required the client to pay all expenses related to the mortgage, including notary fees, property registration fees, administrative fees, and appraisal fees.

As a result, the consumer was unduly charged €1,400 in mortgage expenses.

The lawsuit filed by Nieto Jones

Given this situation, Nieto Jones took charge of the matter and, on November 29, 2023, filed a civil lawsuit exercising the individual action for the annulment of general contract terms, claiming the declaration of nullity of various abusive clauses.

The sentence of the First Instance Court

On March 5, 2025, the Court issued a judgment in our favor, declaring the clauses regarding mortgage expenses, default interest, and early repayment null and void, and ordering the bank to reimburse our client for mortgage expenses plus the corresponding legal interest. Furthermore, the financial institution was ordered to pay court fees.
