News (I): The Supreme Court confirms that the maternity supplement does not expire

The main obstacle that pensioners who are claiming their maternity supplement have been facing is the criteria applied by the Social Security office, which states that the right to the supplement no longer exists if more than five years have elapsed since retirement.

Although this criteria is being rejected by the courts, the INSS has unfortunately been forcing pensioners to go to court in order for their right to the supplement to be recognised.

However, last week we received very good news! A recent Supreme Court ruling has confirmed that the right to receive the maternity supplement does not expire, which means it can be requested even if more than five years have passed.

The INSS has lost its only argument for refusing to recognize the supplements, so many positive outcomes are on the horizon for those pensioners who have not yet seen their right recognized.

What is the maternity supplement?

It is a supplement of between 5% and 15% applicable to the contributory pensions of those men (as it was automatically applied for women) who accessed their pension between January 1, 2016 and February 3, 2021. Men have the right to collect the supplement retroactively and to collect all corresponding payments from the effective date of their pension.
